Borrower’s Agreement & Policy for the use of items

1. To borrow items from Buy Nowt LS6 Library of Things, you must be registered as a member. Members must be aged 18 or over.
2. Prior to borrowing items, all members must (a) complete a membership Application; (b) sign the Waiver and Indemnification Form; and (c) have their residence confirmed by a Buy Nowt LS6 Library of Things volunteer or member of staff. Completing a membership Application includes the completion of the Membership Application form and verification of the Member’s identity.
3. Only the member is authorised to use Buy Nowt LS6 Library of Things items. The member shall not permit the use of items checked out to him or her by any other person unless with the express permission of Buy Nowt LS6 Library of Things.
4. Members will be asked to make a donation according to the stated rate for borrowing any item.
5. All items borrowed are to be returned to Buy Nowt LS6 Library of Things by close of business on their Return Date. The return date will be agreed by the borrower and the Buy Nowt LS6 Library of Things.
6. Members may renew each item if (a) the member contacts Buy Nowt LS6 Library of Things by noon of the Return Date, and (b) no other member has previously reserved the item. Buy Nowt LS6 Library of Things reserves the right to refuse or limit renewals. Buy Nowt LS6 Library of Things reserves the right to refuse the loan of any item at its discretion.
7. Buy Nowt LS6 Library of Things staff are available to assist in explaining operation of items. However, by taking possession of any item, the member is certifying that he or she is capable of using that item in a safe and proper manner and will do so in a safe and proper manner.
8. Buy Nowt LS6 Library of Things will only be liable to you for loss or damage caused by our negligence in failing to tell you about a known fault. The library of things will not be liable for faults of which we are not aware. Please see the liability waiver below. Other than this Buy Nowt LS6 Library of Things excludes all liability for death or personal injury caused by our negligence or breach of contract. Note: because we are not a business, the risk to you is greater than if you were to hire any item from a commercial concern or were to buy it.
9. The member agrees that Buy Nowt LS6 Library of Things is not responsible for any manufacturing defects in quality of workmanship or materials inherent in any borrowed items. Each time you take an item out you must check it visually before you take it, and make other checks for any faults that you may be able to identify before using it. The member agrees that if any borrowed item becomes unsafe or in a state of disrepair, he or she must immediately discontinue use of the item and notify Buy Nowt LS6 Library of Things.
10. If you are borrowing electrical equipment you must check the visible wires and plug for any damage before use. If you are using the item outside, moving it about, or using it in circumstances where it may encounter water, anything sharp or other electrical wiring, you must use a circuit breaker.
11. If you reserve an item to borrow that is lent to the Buy Nowt Library of Things by someone then you may have your reservation cancelled if the person lending it to us wants it back before your reservation. 
12. The borrower must take reasonable care for the item. All items are to be returned in the same (or better) condition as they were issued, barring normal wear and tear. All items must be returned clean and the Buy Nowt LS6 Library of Things may charge the member £5 to cover the cost of cleaning. The member agrees to pay for the loss of or damage to any item and further agrees to accept Buy Nowt LS6 Library of Things’ assessment of condition of items and to further agree to the Buy Nowt LS6 Library of Things’ assessment of fair restitution for damage, dirtiness, delinquency, and/or loss of items in part or in total. This restitution amount could equal the full replacement cost of the item plus a £5 administrative fee.
13. if an item is damaged when you are using it you must report it when returning it even if it appears to be functioning normally. if you don’t report then you may be refused service in future or fined. 
14. Some things require consumable parts (e.g. sanders have sanding pads, jigsaws have blades, etc). Please note they are not guaranteed to come with the tool. You may have to buy your own blades, sanding pads, etc… If they are provided, you should bear in mind that these consumable parts come at a cost, and should you use them, you should either replace them, or cover their cost (e.g. 50p for a sheet for a sander).
15. If a thing is returned late, you will be responsible for a late fee. We do not want to do this, but it makes members remember the next time. Other people are relying on you to return the tools, so please be considerate. This late fee will be £1 per day per thing for every day until the tool is returned. Late fees are capped at the full replacement cost of the thing plus a £5 administrative fee per tool. Late fees must be paid in full before borrowing further items. Buy Nowt LS6 Library of Things may replace severely delinquent tools, holding the Member responsible for the full replacement cost plus a £5 administrative fee. Fines must be paid in full before borrowing further items.
16. If Buy Nowt LS6 Library of Things is not the owner of the item and only facilitates contact between you and the Owner, Buy Nowt LS6 Library of Things accepts no liability for the condition of any item or any loss or damage resulting from your use of it.
17. If a member borrows an item and with our written agreement passes it on to another borrower before it is returned to us and booked in, the first member remains liable for the return and condition of the object until it is returned to Buy Nowt LS6 Library of Things. If a member collects an item from another member with our agreement, the terms of this written agreement will apply.

Buy Nowt LS6 Library of Things reserves the right to use appropriate steps to retrieve delinquent tools or unpaid fines and late fees, including the use of a collection agency and/or legal action and assess the delinquent Member with the cost of any such action. Under UK Law, ”borrowing without the intent to return” is theft. Buy Nowt LS6 Library of Things reserves the right to contact the police to retrieve tools if it deems such action appropriate. The Nowt LS6 Library of Things also reserves the right to forgive late fees due to special circumstances.

I have read and fully understand the rules and regulations of Buy Nowt LS6 Library of Things, and I understand that failure to comply with any of these rules may result in revocation of my borrowing privileges and/or legal action against me. I relinquish any and all claims against Buy Nowt LS6 Library of Things.
